Court declines request to stop PDP LG, state congresses in Kaduna

A Federal High Court in Abuja has rejected a request to prevent the People’s Democratic Party, PDP, from proceeding with its planned local government and state congresses in Kaduna State.

Justice Peter Lifu also denied a plea to restrain the Independent National Electoral Commission, INEC, from overseeing the congresses, which are set to elect new party officers at both the local and state levels.

The court’s decision came in response to an ex-parte application filed by six disgruntled PDP members from Kaduna State. After considering the arguments presented by their lawyer, Mr. Affis Matanmi, the judge ruled that the requests for restraining orders against the congresses could not be granted.

Despite the denial, Justice Lifu advised both the PDP and INEC to pause any further actions related to the congresses due to the ongoing litigation.

The case, identified as FHC/ABJ/CD/1144/2024, was brought by six plaintiffs who are card-carrying members of the PDP in Kaduna State. The plaintiffs are Sheu Isa Ina, Mutari Shuiabu, Yusuf Suleiman, Nura Waziri, Malam Mansur Alasan, and Jaafar Abubakar.

PDP, the PDP Kaduna State chapter, and INEC are the 1st to 3rd defendants, respectively, in the suit.
Meanwhile, Justice Lifu has fixed August 27, for the hearing of a motion on notice for an interlocutory injunction by the plaintiffs.
