Benue Governor Suspends Attorney General Over EFCC Suit

Benue State Governor, Hyacinth Alia, has suspended the state’s Attorney General and Commissioner for Justice, Fidelis Mnyim, following his involvement in a legal challenge against the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices and Other Related Offences Commission (ICPC).

Mnyim joined 19 other states in questioning the constitutionality of the laws that established these anti-corruption agencies.

The case was recently heard by the Supreme Court, which reserved its judgment.

The 19 states, including Benue, argue that the 2004 law that set up the EFCC was not in line with Nigeria’s Constitution.

According to the plaintiffs, the EFCC law should have followed the procedure outlined in Section 12 of the Nigerian Constitution, particularly regarding the adoption of international conventions into national law.

The legal dispute also involves some states withdrawing from the case, while others, such as Imo and Bauchi, are co-plaintiffs.

Osun State has requested the consolidation of the case, but the court is still set to announce a date for judgment.
